Desperate Cry for Action MMAIL(thurs 12/2/09)

4.30 pm -
I was called up by the press on my view yersterday based on SELANGOR GOVERMENT ORDERED MPAJ TO HOLD MEETING WITH RESIDENTS AND LANDOWNERS.....WITHIN A WEEK. I did post the statements made in my blog. Today's article says it all. My only comment is the photo on this article is not justifiable as we described 'torn and tattered' tarps. Tarpaulins seen on this picture are just newly laid after the 5th Feb landslip. (2nd occurence after 6 Dec)

The FORUM

3.55 pm -
The forum called by Tan Seri MB to be chaired by MPAJ must serve its purpose that is after the long waited more than 2 months. The forum must have an objective. The OBJECTIVE IS THE SOLUTION to the problem followed by the will to be immediately carried out. We had requested for meetings with the developer together with MPAJ BUT the DEVELOPER FAILED TO TURN UP. MPAJ had close door meetings with the developer which have no solutions. We don't want a forum that is just going to pacify us. We want actions, we have said enough. WHAT NEEDS TO BE SAID HAD BEEN SAID BUT WHAT NEEDS TO BE DONE HAS NOT BEEN DONE. We would have achieved 10 % work to be done by the time the forum is over! TIME IS THE ESSENCE.

General update

10.50 am -
I was at YB M.P office to hand over cc of MPAJ petition. I was made to understand that work ministry will present JKR N issue on slope with a substantial rectification work on the overall to cabinet today. I am in no position to commend but if this come through, we would be very thankful. On other matters:
  1. Our effort on public awareness seems to be effective. We have coverage again Malay Mail & Star Metro on 10 Feb. Today 11th Feb SUN page 7.
  2. I am now at MPAJ office to follow up on 3 month subsidies for WARGA TUA for residents whom had appealed.
  3. Working on 'directly' affected house 15,17,19 in their interest to pursue further.
  4. Committee meeting is on tonight. Our concentration & priority is THE SLOPE.
I am aware of other issues like Feb rental subsidy, TNB & Syabas bills and also a better administration of communication. They have been addressed but need to be followed up. In general, I shall try to put all work done in my blog. We are all trying.

Background

In the early hours of 6th December 2008, a landslide occurred on the land located on a man made slope between Jalan Wangsa 9, Taman Wangsa Ukay, Ampang and Jalan Bukit Antarabangsa, Taman Bukit Mewah, Ampang. Both residential areas are located in what is generally referred to as the Bukit Antarabangsa area under your jurisdiction.

A direct consequence of this landslide was that in Taman Bukit Mewah, located on flat land at the bottom of the landslide, 14 bungalows were destroyed with the loss of 5 lives and several injured. A further 20 houses were damaged and these will require from minor to fairly extensive repair works to restore them to a state safe and fit for occupation again.

Jalan Bukit Antarabangsa was cut off together with Jalan Wangsa 9 located at the top of the failed slope resulting in thousands being inconvenienced due to the only vehicular access to their homes being blocked by the landslide. The affected housing schemes included Taman Bukit Mewah, Taman Bukit Jaya and the various condominium schemes like Oakleaf Park, Kyoto Gardens, Impian Selatan etc.

To date, based on an initial report by JKR, 81 houses have been declared unsafe for occupation and the owners/occupiers prevented from occupying their homes. Power and water supply to these homes have also been disconnected. These homes are located in Taman Bukit Mewah (20 homes), one block in Impian Selatan condominium (27 homes), Jalan Wangsa 9 (23 homes), Jalan Wangsa 11 (3 homes) and Jalan Bukit Jaya 6 (8 homes).
This evacuation notice was prompted by concerns regarding the stability of the failed slope which will endanger these houses if there was further deterioration.

As early as a week after the incident, it was made known that the JKR Slope Engineering Unit had proposed an immediate remedial plan for stabilizing the failed slope to prevent further deterioration of the slope and surrounding properties. This plan which included measures like soil nailing of the slope below Jalan Wangsa 9, was submitted to MPAJ as the Local Authority for consideration and further action. To date, more than 2 months after the slope failure, other than work to reopen Jalan Bukit Antarabangsa in time for the new academic year, actual remedial works (other than slope investigation and monitoring works) to the slope has not progressed beyond the initial efforts to cover the top of the slope with tarpaulins, repairing drains and sumps (at the request of the residents) in the vicinity of the failed slope and draining of water from a pool that formed at the bottom of the failed slope.

Currently, the tarpaulin cover to the top of the slope on Jalan Wangsa 9 have ripped, further exposing the bare slope through a combination of movement caused by the further collapse of the lip at the top of the slope or general wear and tear. The edge of the collapsed slope which was at the outside edge of Jalan Wangsa 9 on land belonging to Superview Development Sdn Bhd has now eroded to a point less than 10 feet from the boundary/front gates of some houses on Jalan Wangsa 9.

Why immediate action is needed

There is no disagreement from any party to the fact that the failed slope, if left unattended either by way of immediate slope stabilization or a complete rebuilding to restore stability is inherently UNSAFE. The weather had been benign and there was no repeat of the rain spell experienced prior to and in the immediate few days after the occurrence of the slope failure, but this is only a TEMPORARY reprieve. In the last two weeks, the weather has taken a turn for the worse and it has been raining almost daily. Several minor land slips have been reported in the last week, most recently on 31st January 2009 and 5th February 2009. The slope will fail again if left untreated and this will put in jeopardy the remaining houses located on Jalan Bukit Antarabangsa, Impian Selatan, Jalan Wangsa 9, Jalan Wangsa 11 and Jalan Bukit Jaya 6. JKR’s monitoring of the structures after the landslide indicated that these houses although declared unsafe are in fact structurally sound and have remained uncompromised. It is irrefutable that further failure of the slope due to a lack of action NOW to safeguard its stability will cause this situation to change dramatically and probably irreversibly for the worse.

The Facts

Taman Wangsa Ukay was developed by Superview Development Sdn Bhd (SDSB), a subsidiary company of MRCB, a company listed on the Bursa Malaysia, in the eighties and the whole hillside from the Wangsa Heights Condominium on Jalan Wangsa 7 down to the bottom of the hill demarcated by Jalan Bukit Antarabangsa is a man made slope. This slope generally consists of earth berms (using fill material) with bench or berm drains with some crib retaining walls located behind some houses.

Completed houses located on Jalan Wangsa 3, Jalan Wangsa 5, Jalan Wangsa 7 (including the Wangsa Heights Condominium), Jalan Wangsa 9 and Jalan Wangsa 11 were handed over to purchasers from the late eighties to the early nineties. The houses located in Taman Bukit Mewah were completed in the nineties.

Between Jalan Wangsa 9 and Jalan Bukit Antarabangsa, are located several blocks of uncompleted houses which have been left in an abandoned state since the late eighties with no sign of any activity to maintain them or the associated bench drains within the building lots in a serviceable state. The continuation of Jalan Wangsa 11 beyond the last occupied house addressed No 82, was left uncompleted with no evidence of the road works, drainage and street lighting having ever been completed or installed. A kawasan lapang located at the bottom of the slope was never completed with landscaping or play equipment installed for the benefit of residents in the area. A cursory survey of the state of the land and the abandoned buildings will back up any assertion that there has not been any reasonable effort made to maintain the land or buildings, especially with respect to drainage of the slope, in a manner that could be deemed fair and reasonable so as not to cause nuisance to the adjacent landowners.

In the last few years, SDSB had tried to apply for Development Orders to develop their land located where the slope failure occurred, the last was apparently in 2002, to redevelop the abandoned building lots but these applications were unsuccessful. Meanwhile, maintenance activity on the said land was visibly lacking with adjacent owners on Jalan Wangsa 9 and Jalan Bukit Antarabangsa resorting to calling MPAJ to clear fallen trees or listing trees.

The Implications under the Street Drainage & Building Act

It is clear under the Street Drainage and Building Act that property owners and landowners are not to do anything that will result in nuisance or endanger public health or their neighbors or they can be summarily dealt with under Section 86 of the said Act. There are provisions for the Local Authority (in this case MPAJ) to take action to ensure compliance with this as is provided under Part VI Section 91 (Mandatory Order) of the Act, so that ordinary citizens can live in an environment in peace and safety. In the event that there is clear and present evidence that the continuation of an activity or neglect will result in a threat or damage to properties or lives of adjacent neighbors, the Local Authority and the Land Owner whose property or land is the source of the threat MUST take action or be held liable for damages directly or indirectly arising. The Local Authorities can take action to safeguard public health and safety and then recover costs from the offending landowner.

In this instance, the current state of the failed slope which has already claimed lives and property still represents clear and present danger to the remaining houses located on Jalan Wangsa 9, Jalan Wangsa 7, Jalan Wangsa 11, Jalan Bukit Antarabangsa, Jalan Bukit Mewah 1, Jalan Bukit Mewah 2, Impian Selatan and Jalan Bukit Jaya 6.

This potential of further damages is both foreseeable and preventable if action is taken NOW!

It is apparent that while the MPAJ is engaged in a case of trying to establish or deny blame, this fact of continued and imminent danger to the remaining houses has been overlooked with little regard to the potentially catastrophic consequences of this inactivity. We will hold you and the Majlis Perbandaran Ampang Jaya liable for your negligence in spite of warnings that are clear and cannot be ignored.

The Menteri Besar had declared publicly at a press conference on site on 21st December 2008 that the State and the Local Authority have the power and means to go ahead and act to secure the slope and prevent further damages in order to safeguard property and lives and that the present State Government had the resolve to do just that.

The Jabatan Kerja Raya (JKR) through their Slope Engineering Unit under Ir Kamar Kassim had also stated that they will prepare a comprehensive study of the catastrophe and prepare a report that will cover the cause and effect of the landslide and recommend a plan to prevent a recurrence. This report shall be duly presented on 19th January 2009 to the parties having jurisdiction to be acted upon. To date, there has been no word on the actual status of that report.

Today, 2 months have passed since the landslide, there has been neither confirmation nor activity of any sort to make good on promises made, the slope condition is getting critical and we as the rakyat have a right to demand at least a measure of consideration from those in Authority.

An Appeal for ACTION

Dato’ YDP, we appeal to you as the Yang DiPertua Majlis Perbandaran Ampang Jaya and your good office, who are entrusted with the duty and responsibility to look after our interests in this matter, to act NOW to safeguard our interests as outlined above or we may be forced to hold you and the Majlis Perbandaran Ampang Jaya accountable for any damages whether directly or indirectly arising as a result of no action being taken by you and the majlis Perbandaran Ampang Jaya in spite our our appeals to Dato’ YDP and the Majlis Perbandaran Ampang Jaya.

Looting Attempts at Wgsa 9

Dear residents,
At 8.45 pm , I was in a shopping mall with my family (1st time since the mudslide) wanting to do CNY shopping when Ganesan, our gardener and caretaker called to inform me:
- house 31 water filter pipe was cut and some screws were taken out with the clear attempt of stealing.

IMMEDIATE ACTIONS -

  1. Called TYDP MPAJ to reach out MPAJ tent (24hrs) to send someone to tighten the security. I had requested for the police to be stationed at emergency exit many times to the attention of MPAJ, YB Adun office, MB's office, YB MP Ampang and local counsel. Residents themselves made personal effort too. To date nothing has been done. It is a tradition that our BOLEH always wait for something to happen first.
  2. Informed the respective owners to check and make police report which when I was at the site, owner of house No. 31 was already making his police report at the police station.
  3. Called Raymond to see if he could go to site.
  4. With such disruption, I decided to go to site. The police escorted my husband and I to the end of Jalan Wangsa 9 at about 9.20 pm. Raymond came and we concluded that we need more lightings and Ray will see OCPD tomorrow.

Tomorrow I shall be in Bukit Antarabangsa with RTM to do a small coverage in conjunction to CNY. The press is keen to be there too.

Subsidies from state goverment

Bravo! With reference to the above our long waiting to the aid has finally come true. YB Adun's officer just confirmed that the aid had been drawn down to MPAJ. MPAJ had also confirmed receiving it. At the same time MPAJ would like to make its stance clear on the entitlement on the benefit of RM500 (for 3 months only) are only available to:
  1. OKU
  2. WARGA EMAS KURANG UPAYA
  3. FAMILY EARNING LESS THAN RM 1,500 PER MONTH

This just one of the other benefits. Please check KENYATAAN MEDIA for further reference. Our last meeting with MPAJ on 31st December 2008, I had proposed on your behalf that all cheques will be collected at MPAJ at Pandan by your good self to avoid any unforeseen circumstances. I am happy for all of you.

Latest Update - 30th Dec (III)

11.15 pm :

  1. At 2.30 pm, Henri from Wangsa 7 and myself met up with MP Ampang YB Zuraidah and we requested for quick response to do up the slope.
  2. At 3 pm - Informal discussion with YB Azmin officer to ask for feedback on the administration of RENTAL SUBSIDY, water and electricity to be put back and close monitoring of MPAJ.
  3. At 4 pm - Attended JKR Brief, MP joined later and immediately secure appointment for us tomorrow to meet with YDP MPAJ, superview and JKR since superview is taking too long to act. Chee will post the minutes of the meeting.
  4. At 8 pm - I visited our helpful chief of ops MPAJ at amp.put.hosp. due to exhaustion. He was sleeping at the site to ensure work goes on. PLEASE BE INFORMED THAT MEMORIAL SERVICE TO PAY RESPECT TO THE 5 DECEASED WILL BE HELD AT THE TRAGEDY SITE, Jalan Bukit Antarabangsa tomorrow, WEDNESDAY, 31st December 2008 at 8 pm. Good News

Dear residents,
Good news everyone. I have told Angie to relate to all that we have good news while I was in the Committee and Reps meeting with MB and ADUN. In general and specifically all affected residents of Jalan Wangsa 9 are to be compensated with RM 1,000 monthly until the day we can go back to our homes OR PKNS semi d (only 14 units available) in Balakong rental at RM 100 for the first 3 months and thereafter RM 500 until Wangsa 9 is ready.
Other fringe - families with disabled members and families with income less than RM 1,500 per month will get extra RM 500 (for 3 months only) and we are also entitled to RM 120 voucher (by GIANT) for bags, school uniforms and shoes for families with school-going children. All registration will be at MPAJ disaster center. More details will be confirmed in the residents meeting tonight. I HAVE YET TO POST THE PARTICULARS TO THE WEBSITE. SO PLEASE BE PATIENT.

With reference to the Kenyataan Media Polis Diraja Malaysia on 20th December 2008, we, the representatives of the evacuated residents of Bukit Antarabangsa respectfully request that YAB Tan Sri Khalid and ADUN YB Encik Azmin Ali to look into concerns listed below:-

1. Can we assume that we can move back before or by the duration provided by the Kenyataan Media Polis Diraja Malaysia on 20th December 2008, for each of the six areas affected by the landslide so that we can plan our lives to move in no later than the respective dates given.

If for any unfortunate situation, the deadlines cannot be met, what are the supports or aid that you are committed to offer us during that period of uncertainty?

2. How can we be assured that concentrated effort is being made to expedite the rectification work to alleviate prolonging our stay away from our homes?

3. Could you inform us what are the proactive measures that you have initiated to alleviate sufferings including but not limited to:

...3.1 Outstanding loan, waiver of interest and deferment of loan repayments
...3.2 Displacement and relocation cost effective 6th December 2008 until further notice

4. During these periods that we have vacated our homes, what measures will you implement to ensure the safety, security and integrity of our properties?
5. If these measures are taken, how can we be sure that they are ongoing during the entire period of our displacement? E.g. Wangsa 9 and Jalan BJ 6A, Taman Bukit Jaya, only authorized personnels and owners are allowed to go in.

6. We would like to request the state government to provide each evacuated resident a letter certifying the effective date of the evacuation as a direct consequence of the landslide that all services should be suspended effective 6th December 2008 until further notice.

7. We would like to have the assurance that the JKR communication center is in full operation on weekly if not daily basis to update the residents until every resident has been fully resettled.

8. Notwithstanding the fact that we would insist on having a copy of full report (meeting with the YAB on 14th December 2008 requested for the reports as on item no. 3) of this investigation, what are your remedial actions, rectification plans and preventive measures for the entire Bukit Antarabangsa to ensure the long term safety and livability of residents here?

We have been neglected long enough to the extent that this disaster had taken place, we now plead to your good office to put things right for all the residents of Bukit Antarabangsa.

Latest Update - 19th Dec

Dear residents,
Well.... We are trapped in between state and federal matters. MB was supposed to announce this morning but report was given to other ministry and not state. So MB did a press statement last night himself. Somehow, MB got the report at 1 pm today. MB will announce on Sunday definitely true. I was at JKR meeting just now mainly addressing the progress of work and matters to be attended. Some questions posted like how long to wait, although JKR told us to wait for announcement. About 5 pm+, Datuk told me that there would be a press conference. CPO will do the announcement at SUBANG HOLIDAY VILLA, 10:30 am, SATURDAY (tomorrow). You know that emergency cabinet meeting was called so I guess that's how they derive at tomorrow's press conference. So it looks like we will have to wait for the announcement to decide.

Issues of Concern by Residents of Bukit Antarabangsa Resultant from the Recent Landslide
We, the representatives of the residents of Bukit Antarabangsa, after several meetings with the residents, wish to bring to your attention the following issues :-
Points for discussion:

1. SEEKING IMMEDIATE SOLUTIONS :
  • The missing maid of Mr. Thana and the late Dr. Yoges
  • It is not 14 houses that are affected but it is in fact 24 houses
  • A need to survey and inspect all properties and its surroundings. E.g. the main drain (beside the main road which are showing new cracks)
  • Jalan Wangsa 9: when can the road be reopened

2. COMPENSATION :

  • We want to echo MB’s statement.

3. REPORTS & FINDINGS :

  • We insist these be made available to the committee and thereafter to the public. E.g.:
  • - JKR Report
  • - IKRAM Bhd Report
  • - Jabatan Mineral and Geoscience Report

4. ASSISTANCE ;

  • In the event a need to remove / demolish properties, the owner or his appointed representative is present (non-negotiable).
  • Basic needs – reestablishing of water supply
  • Support and financial assistance to the families of those who perished in the disaster
  • Appointing our committee member be part of your investigation committee
5. VOICES FROM THE RESIDENTS
  • We have 12 categories of major concerns which need to be addressed immediately
  • The committee is continuing to collect and collate feedback from the residents
