Tuesday 5th Oct 2010 - Responding to my letter dated 2nd SEPT 2010 ,TNB En Shakri and En Norizam and team were present to do light inspection on properties with MPAJ Ir Zolkeflee and En Rojohar. Residents present- hse 47,43, 31, 29, 23, 19, 17, 15,11, 7, and 1.

TNB RECONNECTION OF ELECTRICITY
Kindly note electricity meter will commence reading effective 5th Oct. It is the responsibility of residents to ensure main switch on their distribution board is switched off to avoid reading of 'non usage'. Residents who could not make it kindly note.
SYABAS RECONNECTION
I had gone to SYABAS GOMBAK FRI ,30th sept. Residents need to clear outstanding bill n request for reconnection. I could authorised reconnection for properties with no arrears.
Meters will be installed WED 6th Oct for hse no 1, 15, 19, 23, 43 and 47. Hse no 5, 31 and 33 need fresh applications.

THURSDAY 30TH SEPT'10 -Dear Wangsa 9, Kindly be notified that rectification work on Wangsa 9 is near completion. There two things that needed immediate attention and cooperation 1. APPLY FOR WATER SUPPLY RECONNECTION at Syabas GOMBAK. Residents are required to do this on our own accord. Requested from MPAJ to liaise with syabas to waive any outstanding for the last 2 years but it is not coming through.
2. TNB will be at Wangsa 9 and need access to our properties to do light check and remove main fuse. Please be present to open up your house TUESDAY 5TH OCT 10AM .

18thMAR10 -1. Follow up with HCM, MICROPILLING is in progress and 25pts completed. Total 285pts required for this task. Some technical problems encountered but can be ovecomed. Site work is going on till 10pm daily to meet date line. 2. Last week HCM had meeting with responsible authorities-MPAJ, SYABAS, INDAH WATER and TNB. Ref.: Follow Up of Issues Proposed by Residents of Wangsa 9, Bkt. Antarabangsa

With reference to our tele-conversation on Tuesday (12th January 2010), these are the following issues the residents would like to propose. These issues have prior been highlighted to the attention of Encik Othman bin Idris on 28th October 2009. We take this opportunity to thank you on a cordial meeting we had with your department on the 28th October 2009, with the presence of Puan Noor Azaliah binti Hassan, Encik Rojohar Salleh and Encik Amran Ismail (Jabatan Perbandaran). Encik Othman has now been transferred to MPS, we hope you will be able to continually support our requests as listed below:

To represent us as an official communication channel to liaise with all related authorities in particular JKR.
We would like to know a definite date for evacuees to go back to their homes.
The respective designs on the failed slope by JKR.
Security – some immediate measures need to be looked into seriously since there has been several breaking-ins. The last one just occurred on the first week of January this year. All water meters on Jalan Wangsa 9 have also been stolen as on the 2nd of January 2010. All evacuees are very concerned with their properties being invaded by strangers.
Waver of quit rent and land assessment for the year 2010.
Lightings on Jalan Wangsa 9 – spots lights which were installed previously, only two are working. If more lights are installed, the place will be lit up better hence will deter intruders from taking opportunities on the abandoned houses.
Temporary supply of water and electricity for general upkeeping since the house has been abandoned for more than one year.
Recompact and repave the new road for the other half of Jalan Wangsa 9 (further proposal on this will be written in to your attention again).
Proposal of underground cables – please refer to the letter dated 21st Oct 2009 as attached.
Landscaping of proper fencing and trees that needed to be pruned once the properties ready for habitation.

UPDATE- Progress of Work on Failed Slope

Meeting with HCM and sub contractor this morning 10am has concluded that soil nailing is near completion, 15 percent of work left. Estimated to be completed just before CNY ie mid February. Micropilling will commence then but they are facing a hiccup of storage and place for machinery which has indirectly affecting the work progress. Mr Yap and myself have been working on this for the last one week. Micropilling will take 4 months base on 12 hrs daily. HCM indicated the whole project will complete in OCTOBER.

I attended the above event,basically COBARA agenda is on prevention.

JKR WORK ON FAILED SLOPE- spoken to YB Zuraidah on working with JKR to expediate work on failed area so to enable evacuees to return home soonest.
SECURITY-highlighted police officers from ulu kelang station and reminded more frequent patrolling to safeguard all abandon properties eg.wangsa9.
MAILS- I have recently followed up and received feedback on mails and i gather that all mails for evacuees are now in the retention post office TMN MELAWATI. I could not find time to attend to this today. I shall check with the post off next week.

With reference to the above, I am contented that the meeting (site inspection) went well. Chek from house 27, Jalan Wangsa 9, was present. There were 10 people from MPAJ - Jab. kejuteraan Pn Noor Azaliah and En. Rojohar Salleh , Jab. Perbandaran, En Amran Ismail and staff, Alam Flora contractor, En Ismail, En Zaki and staff (En Otman Idris was unable to make it this morning but shall arrange a separate meeting).

The discussion went well and all the 10 issues (which were posted in my blog WED 28 OCT 09) were delivered. I shall follow up on this in black and white.

On upkeeping the frontage and backyard of Wangsa 9 which is in a 'dilapidated' stage gets immediate attention. A massive operation of 3-5 days, starting tomorrow from 8.30 to 5pm will be carried out by Alam Flora. I shall be there on and off to make sure a good job done!

MPAJ Meeting

Meeting with MPAJ at Wangsa9 3 pm today has to be resheduled due to heavy rain. Reconfirmed meeting, Friday morning at 10 am.

10 issues to be brought up and discussed are as follows :

MPAJ as our communication channel
Firm date going back so to allow residence plan their expiring tenancy agreement early December 2009/January 2010
Arrange meeting with JKR to understand the tecnicalities n design implemented on failed and related area
Maintainance of front and backyard common area which are now mosquitoes breeding and snake hibernation grounds (to address complaints frm house 28 and house 34 Jalan Wangsa 7)
To put back temporry water and electricity which had been repeated requested from day 1
Look into the implementation of underground TNB/telephone cables
To request for better provision of lightings in the area (temporary and future) where only 2 spotlights are working out of 4
Security
Future landscaping (fencing) and upkeeping of existing trees

Update & Follow Up W9

About 12.35 pm, I have spoken to TYDP MPAJ after failing to get hold of En Othman.

Need to know the outcome of the clogged drain and at the backyard of Wangsa 9 and 7. No respond from En Othman after my sms to him on 19 October (1 week ago). On Sunday 25 October, I was in Wangsa 9 and called up hotline MPAJ after receiving another complaint from House 28, Wangsa 7. I was in Wangsa 9 this morning and no action has been taken to rectify the complaints.
Informed TYDP on the letter submitted to MPAJ 1 week ago (by Bismi, House 11 Wangsa 9) on 'underground cables tel/TNB'
Met up with En Azmi, who is manning the ICU office at Jalan Bukit Antarabangsa. There is a lot to iron out on who is to follow up on what. It is quite clear that there's poor integration in coordination among leaders here and I would just hope everyone who does it has sincere intention to save Bukit Antarabangsa.
Work on failed slope is progressing but rather slowly. We are still awaiting for a definite answer and commitment on when residents are allowed to go home.

I have just spoken to En Khairil on the clogged and non maintained drain at the back of Wangsa 9 which I have also received complaints from residence of Wangsa 7 . I would like to bring to your attention and would appreciate if you can get a team of workers to clean up the backyard which is not only filthy, snakes are also found to be staying since there are no occupants in Wangsa 9. Work Progress on Failed Slope (W9)

HAPPY DEEPAVALI TO ALL. We all know that work has been going on but we hope and expect HCM to expedite it. After Raya , about 29th September 2009, HCM has started to do back fill on the soil nailed stretch along Wangsa 9. In about 3 weeks time from now HCM will commence micropiling. We are now waiting for an appointment next week to see respective authority to discuss on:

Confirmation of time for us to return
Make good of houses with cracks
Details of design
Laying telecom cable underground
Landscaping

On a separate matter Ganesan will not be doing his usual rounds from 17-19 October. He will be replaced by someone else, Kumar. Kindly note.

October - General Updates

With reference to the above, the OCT RENTAL SUBSIDY is ready for collection. I hope residents who are entitled are now familiar with the payout. I have not been posting this notification in my blog as a constant monthly reminder because my constant follow up with MPAJ feedback from residents have been satisfactory. Well, I have to commend that MPAJ has generally improved in its service!

2. GENERAL MAINTENANCE OF WANGSA 9 - My earlier post has requested fellow neighbourhood to keep their backyards grass neat but not all of us are attending to it! Please, attend to it. 'Our' caretaker told me just this morning that king cobras were seen in backyard house 11 and store room house 45. This has to do with the extensive clearing in the front and these cobras are now inhabiting in our abandoned properties. Those who frequent their houses, please do look out.

3. SECURITY - Looters had been spotted occasionally in Wangsa 9. Ulu Kelang police station has dispatched frequent patrol in the area. Most recent incident, potted plants were taken away from House 31.

4. ELECTRIC CABLES which were dangling near emergency staircase (26 September 09) reported and followed up with MPAJ is now in the process of rectifying it.

5. FEES FOR GANESAN all updated to month of Oct- I have paid on your behalf, House 1 - 3 months, House 7 - 3 months, House 19 - 1 month, and House 37 - 4 months.

6. WANGSA HEIGHTS CONDO - According to MPAJ, rectification work will commence soon.

Wangsa 9 Looters Seen @ Hse no.47

Ganesan just called said at 8.20 pm when he was at Wangsa 9, 2 men were spotted trying to loot in front of Captain Hassan's house. They ran away when Ganesan approached them. Would appreciate if you can alert the police on this incident and to do more rounds and if possible down the staircase. Ganesan is rather sure that they were the workers around the area.

Boulders Collapsed for the 2nd Time @ Wangsa Heights Condo

Tuan Syed from Wangsa Heights Condo called to inform me that some boulders adjacent to the condo collapsed. The boulders came down to the condo building's carpark. The same incident had taken place last year on the open carpark which is just some tens of metres away from the location where boulders fell last year. Both incidents had damaged a car. And we are lucky that only 2 cars are sacrificed. Today's incident could have been a disaster if the boulders that came down happened to cripple one of the pillars of the building that houses the residents. The fact is, this is the same repetition of incidents and incidents took place due to the ignorance of our authorities. From last year's incident (similar occurrence) I understand that geological study was made by IKRAM. We all know that some methods of prevention would have been recommended... and it stopped there. The whole history repeats itself. As a rakyat, I am truly saddened by the way our government treat its rakyat. No authorities seem to want to learn anything since the collapsed of Highland Towers. When any of these disasters strike these places will be flooded with huge loads of VIPs to mark their attendances like school kids to sight seeing the place. The issue will take front coverage of all daily for 1 month or so and after that the victims are left to defend for themselves. Having said that we still continue paying our taxes. My family and I are evacuees who until today, still striving to live a normal life away from my abandoned home. We have been told we can go back, initially end of Oct and later was told Dec and last heard 'end of Feb'. JKR has its signage pillars built firmly at the entrance of the failed slope(Wangsa 9) has no courtesy of informing evacuees when we can go back or update us on the progress of work. The work on the failed slope is seemingly slowed down. We have been kept in the dark. One morning when I went to JKR office at ground zero there was no one there! Well, it is expected anyway... By the way, we really do live in a high, mighty and ambitious country where our leaders always cannot even seem to address basic issues of necessities of its rakyat. Likewise we being the rakyat couldn't even give a damp on any campaign our leaders promote. All these campaigns cost millions of ringgit are sucked out from our hard earned money.... Tomorrow is the 1st of Syawal, SELAMAT HARI RAYA TO ALL OUR MUSLIM FRIENDS ESPECIALLY TO HASRUL MPAJ OFFICER AND MPAJ STAFF. HASRUL IS ALWAYS THERE FOR US. Hasrul rushed to the scene once he was notified. He is one of the very few who has taken full responsibilities of his job. How wonderful if we have more replicas of Hasrul. He break fast with a packet of Yeo's offered by Tuan Syed. We would like to note our appreciation to state government for their prompt rental subsidies.

Follow up & Update on Hse 62 Jln Wangsa 1

At 8.30 am this morning, I had gone to have a look at the property and it appeared to be in very much 'physical' damages. No evident crack lines found on the ground where tiles came out and also on the walls within the living and dining area. I went to JKR office and there is no one there. At 3.50 pm, Timb. YDP confirmed that MPAJ had made its inspection today. It would be good if the owners themselves can follow up by getting engineer / architect to check the building thoroughly inside and outside to re-ensure it.

Dear Dato M & Raymond,

I was disturbed to see you quoted a saying that everything is ok with the repair works at Bkt Antarabangsa this morning. Works are behind schedule, security at Wangsa 9 is a problem. Yen's house was broken into just last week and the contractor says it is not his responsibility, while we are still barred from going back to the units. Contractor claimed he hasn't been paid by JKR. So things are NOT all okay if you had checked some facts before making a statement to the press. By the way, the road quoted should be Wangsa 9 and not Wangsa 5. So, Please check with Yen before making a statement or we may have to issue a separate statement for Wangsa 9 contrary to yours and we do not want to look disunited to the press.

Dear Wangsa 9 residents,

With reference to THE SUN PG4 today reported that we are happy with remedial work, few of Wangsa 9 owners are NOT AT ALL happy with the statement made by Dato Muniandy when:

Two houses had been broken in recently;
Remedial work slowed down - can we go back at the end of this year? Where many rental tenancy will expire, where many are still trying to adapt ourselves in rented places, rental places are not 'justifiable';
Cracks appeared after remedial work has started;
Issue on handling d job by JKR to MPAJ still in question.

All these claim that we are happy? Are we? Have the above been attended to? Maybe THE SUN should talk to the victims to understand the real situation. It is definitely UNFAIR for someone to put words in our mouth. I don't understand why the camouflage is for? We are already the victims and we don't want to be victims of any political advantages to any party. Kindly note.

My recent home visit to Wangsa 9 has discovered that Wangsa 9 has now turned into looking real 'abandoned ' row of houses. Not only the street in our front has not been upkept, it is our backyards with LALANGS THAT ARE GROWING TO HEIGHTS DUE TO OUR IGNORANCE which is the issue I would like to highlight to all of you. A cobra 10 ft long was found in the backyard of house no. 25 few days ago. Please take respective initiative to arrange for a grass cutter to keep your backyards tidy. 'Our' gardener will charge RM 100 - 150 (depending on density of grass) for cutting backyards that has been abandoned more than 6 months. For subsequent monthly maintenance RM 30 per month if you wish. You may contact GANESAN @ 012 2524303. Your concerns and thoughtfulness for thy neighbours would be appreciated. I urge every neighbour to cooperate to attend to this matter immediately. I had informed MPAJ to keep our back walkway (beyond our fences) for upkeeping purposes.

HCM-Residents meeting @ HCM site office

Today marks our 6th month since the tragedy. We remember and pray for those who are more unfortunate compared to us. On Thursday, 4th of June, affected residents from house 17,19, 23 and myself had a meeting with HCM, Ir Kamal. A cordial and committed contractor, is willing to look into our requests:

Responsible and repair cracks
To release the report on cracks
General upkeeping of Wangsa9
Future 'external' water piping (follow up)
With unexpected extra 'job' on the failed slope, we have been told that there will be delay in going back to our properties. Will update you accordingly.

VERY IMPORTANT- For HCM to attend to the CRACKS , all residents have to please go back to your property to identify if there is a need for HCM to do it for you. Site office is always open. See engineer En. Borhan and liaise with him how he can be accessible to your property when they need to. Residents must take own interest and prerogative to attend to this. Those who don't feed back , I would assume that their properties are in good conditions.

Kindly note. I have highlighted Wangsa 9 issues to the press last night and NO policemen and security were also been mentioned. I missed that out in my blog earlier. I need to apologise for not putting as much information as I would like to. I have been busy myself. Despite this, please know that I am still monitoring and following up on all concern issues.

6 Months down the road

In conjunction to 6th month of Bukit Antarabangsa landslide tragedy, a dear friend Sheila, someone I call 'woman with a heart of gold' called me to ask "how's the going" and if there are issues to be addressed or highlighted in the media. I am very much thankful to her for the fact that she still remembers. I am not sure how many of us do. Somehow I am conscious over the number 6! Sheila focuses on the overall issues from grievances to forthcoming. After my teleconversation with her, I spoke to 2 chairmen from 2 adjacent neighbourhood to the landslide. Syed Bokhari (Impian Selatan condo) and Farid Faiz (Taman Bukit Jaya - 8 houses evacuated).

Issues concerned (Wangsa 9):

JKR- lack of communication with residents though assurance was given that we can count on them - with recent collapsed stadium in Terengganu which was under JKR- how to restore confidence to the general public especially to 44 evacuees waiting to go home?
Residents are concerned and would like to know about the cracks that appear after stabilizing job on failed slope commenced.
Case on a house buyer, a foreigner whose outfront payment was forfeited due to housing loan was being withdrawn by bank.

General Issues - MRCB & Rental Aid Subsidy

Committee will write in to MRCB following meeting with them on 27th April 2009. The letter in general is requesting for compensation on complete losses and financial aid for evacuees. I requested for 'restoration' compensation clause to be included for unknown defects on our GOOD properties as a result of being left abandoned without water and electricity to enable proper upkeeping. Will post letter in blogspot once it is confirmed.
Rental subsidy RM1000 (blog 8th May) - following my recent follow up with Timb YDP MPAJ (23rd April 2009) on a more systematic disbursement of fund, today, I spoke to YB Adun assistant Khalid to follow up on the monthly aid with state government to be fixed on a specific date of every month.
House 23, Wangsa 9 will be followed up.
Kindly be informed that I would not be able to attend tomorrow's Sun 9th May 2009 Residents Meeting.

Star Interview 29Apr09 : Work Progress on W9 Failed Slope

I was interviewed by Sin Chew (Chinese media) too last week and the article appeared on Saturday 25 Apr where my feedback is residents are rather contented with the progression of work. What is still lacking is the technical communication from between JKR and residents. We have been advised not to intervene with their work and leave this to JKR which will deliver the job in qualified standard of requirement.

As on Tuesday 28 April, house owners from Wangsa 9 discovered cracks on their properties which only happened after the remedial work started by HCM. The cracks were not there before. We would like to know WHO and HOW are they going to make good of the houses? Is the stabilization work on the failed slope been carried out to the standard of expectation? What are the causes of the new cracks? Reason being as a layman's point of view, the cracks appeared due to earth movement. Apart from soil nailing on the failed slope, there suppose be micro pile on the whole stretch of Wangsa 9. This understanding was given to us in JKR BRIEFING in Menara MPAJ on 26 February 2009. To date we have not seen machinery set up for that. The failed area is an area by itself, can micro pile start at the other end of Wangsa 9 ? We were told that with proper progression of work 44 households would be able to go back to their homes by OCTOBER this year. We would like to appeal again to the MINISTRY OF WORKS and with our newly appointed Minister to address our concerns of our problems.

Timbalan ketua JKR had informed me that tomorrow onwards (Saturday 14th March) contractors will start working on stabilizing work to arrest the encroachment to prevent further damage to houses especially no 17. The task is tedious due to the 'vertical cliff'. Concurrently reclamation work will also take place from below. We are being reminded to leave the contractors to do their job which will be supervised by JKR's resident engineer.

Water Supply @ W9 10Mar09 Reconnected & Disconnected Same Day

Water supply to be reconnected has been among the things I have been working on. I understand that water supply was cut off to avoid any unforeseen leakages underground. This has been highlighted to MPAJ and requested MPAJ to retap new temporary water supply from Wangsa 7 to Wangsa 9. Today late morning, Wong, resident 15 Wangsa 9 informed me of the water been connected when he was there this morning. We were all happy for a moment. The next minute Wong also noticed the water leakage on the exposed failed slope. We are all aware of the buried pipes gave way as a result of the landslide. I had to immediately informed MPAJ, JKR and called SYABAS to cut off supply on 6th Dec. 2008. We need to identify the source of leakage. Later, Yap, 17 Wangsa 9 was at the site and he had taken the responsibility to check on every house when pipes house 27 were all opened and water was flushing. We don't have the time to ask every resident to ensure their taps are off so the sure way was to disconnect again. In fact, I spoke about water piping to Dato Ashaari on Saturday 7th March 2009. Would like to check the possibility of proposing that new 'seen' water pipings are to be incorporated in the design of the rectification work likewise with the drains and sumps in one of the JKR meeting with Kamar Kassim (brought up and confirmed by Dato Ashaari on Thursday 26th February 2009). Dato told me to request the plan from SYABAS. I shall follow up on this.

About 11.10am this morning I had a reasonable tele-conversation with Timbalan Ketua Pengarah on 2 major concerns:

Encroachment to house 17 is evidently at its worst over the long weekends (5th slide after 6th December 08)
As promised on Thursday, 26th February we have not seen any substantial set up work for the slope just yet. Mr Selva, the Timbalan gave strong assurance that our concerns are been taken into action that had gone through procurement processes. My questions and requests are immediate protection of tarpaulin to slope as all tarpaulins are all flushed away, work commencement and expectations, person for us to liaise and names of contractors and design. Mr Selva's response: preliminary work, detail survey, setting of site office and logistic work are the concentration within this week. This is definitely taking place as assured by Mr Selva. I am aware and saw a gen set been placed sometime last week and that was about all. Issuance of instructions on scope work to contractors are finalised by JKR. We are being advised by Mr Selva to leave the consultancy n design aspects to JKR which has a proven track record of Malaysian standard of custodian. Work to be accomplished less than 1 year on the failed slope. Project manager will be Dato Baharudin. Mr Selva also will consider to invite 2 representatives to sit in their 1st site meeting. Names of contractors will be on the notice board which will eventually be put on the site.
Tomorrow Wednesday 11 March: JKR will have a meeting with contractors at JKR head off. Mr Selva will be in the position to advise further after the outcome of the meeting. I will follow up again on Friday (13th March).

Lastly I was told to have faith in JKR!

Seminar: Landslides by 'Caw Kejuruteraan Cerun JKR' 7thMAR09

I attended the above seminar held at Flamingo Hotel from 3 pm to 5.30 pm. It's aim is to promote awareness of the general public which also encourage the public to be equally 'responsible' in looking out for signs and general maintenance of slopes. We were also briefed on factors and types of landslides, slope covers and retaining walls. A brief on Town and country planning Act 1976 which section 21 A and 22 are very much lacking (by the way I will update the brochure and other information on my blog too). All these are generally public information so I did not find anything in particular that has the answers to my interest as a responsible hill slope resident. THREE ISSUES AND CONCERNS I BROUGHT UP IN THE SEMINAR were:

After several events of such landslides in our country the 'MAIN' coordinator has yet to be identified. This has to be dealt immediately where CKC JKR must come in to give immediate attention to the already failed slope to deteriorate further. Eg. in Bukit Antarabangsa under the directive of Chief police, the concentration was merely rescue operation which the root of the cause was not attended to. It was more than 10 days before the failed slope was covered with tarpaulins and all broken drains and sumps were patched up after the insistence by fellow Wangsa 9s. We had to initiate and drag authorities to do it. In other words to stabilize the slope was not itemised in the list of our CPO. I am sure MPAJ was being contacted but in view of their lack of proficiency technically and with just 'one' engineer it was an impossible task. Having said this, this 'one' MPAJ engineer is someone we appreciate dearly. It is high time a DISASTER team is to be set up to deal with all sorts of disaster but now in our case, landslide where CKC JKR should be formalised from a unit to a department. ACTION TO TAKEN : Dato Taha and myself discussed and BAAC will write in to ministry of 'bencana alam' to support such move. CKC JKR will then supervise all slope managements and supervise all local authorities on slope developments and maintenance. ISSUE
This seminar aims to educate residents too. As far as Wangsa 9s are concerned, we had been observing all the signs of landslide but all complaints were taken too lightly if not at all over the years. In conclusion MPAJ has a lot to buck up on its engineering department and its strict liaison with developers on maintenance.
This seminar has sufficiently taught us all issues in relation to landslide HOWEVER I feel that we will be more educated if we can get hold of the JKR REPORT to identify and determine the causes of our slope failure which in all cases the general residents and public should be able to be accessible to. We need to know. So far JKR or IKRAM REPORTS have been kept away from the public. I requested for the JKR report. (by the way,we have been requesting all the time) ANSWER :Dato Asahari said that the whole report will be completed in 2 or 3 weeks time and will be in cabinet and will look into making it available to public.

Just followed up with TYDP on February rental aid which has to go in batches due to insufficient fund. It is moving accordingly.
Confirmed JKR will move in anytime since MPAJ has received consent letter from SUPERVIEW at about late 3 pm today. Personally I am very relieved with the progress after 3 months of 'long' battle.

No Policemen at Booth Wangsa 9

Petty, petty little things. I was at Wangsa 9, 8.50 pm tonight and there were no policemen there. I was told by resident in Wangsa Condo that there were no policemen on Wednesday too. I am upset but don't jump the gun just yet! Could it be the heavy rain that had made it impossible for them to stay. Then again we have to ensure that they come back after the rain stops. We will find out. We have been trying to get an extra booth to be stationed at the access staircase and guess what.... we are still following up! Dato M went to see OCPD Ampang Jaya and called after I complained and still not done. Yet to see the extra booth the existing one is now not manned for the last 2 nights. Will follow up tomorrow.

JKR Consent Briefing: OUTCOME

With reference to the above, residents and committee are generally very happy with the outcome of the briefing. Consent letter drafted by MPAJ is very much in the interest of the residents. This is due to the committee's liaison with MPAJ and Dato YDP has been very accommodating in many ways. For the record, this the BEST I have attended since 6th December 2008!

In general,

the target is October for the 44 owners to be back if weather permits and no unforeseen circumstances.
Four contractors have been appointed together with 3 reputable consultants (names will be let known to committee once price negotiation is finalised)
JKR will have met contractors on price negotiation Friday 27th February 2009.
Work is scheduled to start next week.
We will hand in all consent letters by tomorrow (Friday) after Dato T get them stamped. A copy will made for those involved and I will need to collect stamping fees!

Concerns over returning: Impian Selatan

BA residents see light at the end of tunnel when massive RM 70 million is allocated to do the rehabilitation works and 212 owners can return home. However the residents of Block B1 Impian Selatan have come to me to want to know more. I would suggest a need for a firm statement to be made than just being told they can go back. Are their premises really safe to be occupied again considering Block B1 Impian Selatan condo was previouly gazeted under the red zone. This is because Block B1's car park is nearest to where the landslide came down and is currently sunken. Part of the surface at the car park has cracked and dropped 4 inches as a result of the landslide. Since then the sunken area has moved horizontally away from the foundation column and adjacent drains have cracked too. There is a need for relevant authorities who think that Block B1 Impian Selatan safe to be occupied to come up to give a full verification to ensure the safety of residents concerned. RM 70 million rehabilitation work has not included or address the issue faced by Impian Selatan residents.

In response to “70 million on Slope Stability” on the Star.

Finally, we see light at the end of the tunnel. When news got out & been disseminated at 3:45 pm, the whole of Bukit Antarabangsa came back to life. I received non-stop incoming calls to want more verification. Many send complimentary messages and some unknown sender whom I assume are Bkt A residents. The first batch of dissemination went to Dato M, Dato Taha, Chee, Nana, Thana, Ray, Chek and Angie.

In fact, on Wednesday (Feb 11) YB Zuraida (MP Ampang) had told me about “70 million” was to be brought up in cabinet meeting the same day when I went to see her in her office to hand in our petition. I did mentioned to the committee on our weekly Thursday meeting (Feb 12)

We applaud the good news and are very grateful to the Federal government for taking the entire initiative to rehabilitate failed slopes and other measures to ensure safety for ALL HOMES here in BA.

As much as we are very much overjoyed, we are also concern over “the 6 months completion period”. This appears optimistic considering the need for prior:

1. Design & engineering
2. Calling of tender
3. Selection of contractors
4. Disbursement of fund from treasury

Our next agenda, we have to look at, is the concentration to keenly follow-up with the Works Ministry and other relevant departments to ensure that the above matters receives the highest urgency. As much as we are very concern and could not wait to go back to our homes, it is also of crucial importance that we should allow time to make sure that rehabilitation works that will take place have to be done properly to maintain a long term safety.

With reference to the article above, it is really true that Superview Sdn Bhd had no building projects for over 20 years. NOT FOR THE REASON they don’t want to. Their proposed project in between year 2002-2003 (I cannot remember at this moment on the year but I have newspaper cutting somewhere), to revive the abandoned houses on Wangsa 9 and also to rebuild new block of buildings right in front of Wangsa 9 were not approved. For your information, we were the ones protesting against the proposal. So can I say that if we hadn’t had protested, we would have seen some new developments happening on Wangsa 9?

Superview Sdn Bhd stated that they have been periodically maintaining the work on the land, I don’t think so at all. I think my fellow residents will agree with me. Then again, we would be interested to ask what maintenance work has been done. One very good example is, if you have a chance to walk Wangsa 9, you will see how overly-grown trees as high as 50 to 60 feet from the ground and higher than our houses. Each time when it’s going to rain, we can see from our houses the swaying of the trees fears us. I believe the “swaying” is vastly contributing to the fact of destabilizing the ground. Residents themselves will get someone to clean up their roofs at least once a year to avoid clogging by the leaves. We had a few occasions where these trees were uprooted and fell right in front of our properties. Missing a bit, it would have hit our existing homes. When that happened, Wangsa 9 would be cut off from electricity and would have to inform MPAJ to come and cut the trees. Come to think of it, these occasions had been quite good as not to damage cars parked along Wangsa 9. Two occasions which I remember vividly were on houses no. 37 and 39. Of course, we have no evidence going down the slope right in front of us to check on any clogged drains. Residents did bring up complaints about the trees before and after they fell but they have all fallen to deaf ears. At one point of time, the residents themselves took the initiative to collect some money to get a contractor to prune the trees. So how valid is it that Superview SB now claiming that they have been maintaining their land?

Lastly, just a recap for many who are not aware, I would like to highlight again the failed slope (6th Dec) where the cave in comes from Wangsa 9 was also the place where buildings erected by Superview way back in 1985 had collapsed before. As residents, we know that the collapsed buildings were nicely swept and cleaned up as well as some terracing work had been done to put things back, what we would really be interested to find out is, whether a proper remedial work to maintain the stability on the said failed slope was being done way back then. I suppose IKRAM and JKR reports will have full investigation of this failed development parallel to landslide on 6th December. If Superview SB has stated in the write up for their inability to comment on the causes of the landslide, I am recommending that this is one of the causes.

Dear Suhaila / residents,

Sorry that the reply has to come so late when everything is over. Hope you did attend the meeting at Oakleaf. There was no agenda and the residents were generally not happy because the panel has no answers to most questions. To start with, I received an email forwarded to me by MPAJ on 13 Feb, Friday evening. I've been quite known to MPAJ because I have been actively involved in almost everything after the disaster took place. In fact, on Friday morning, committee and myself had a meeting with Dato YDP MPAJ so that's how I came about. The email also been forwarded to our Bukit Antarabangsa counselor, Encik Izzudin, who is supposed to take the prerogative to inform the residents. Since my name appeared so instead of questioning who does the job, I went ahead to inform as many residents / Tamans as possible. Of course, I have not much clue of who are the committee, so I sent to my fellow friends whom I know, who live in most of the Tamans here. So I guess that's how it gets to you. To come to your wanting to know the agenda, I guess I am in the same situation. How this meeting came about is an instruction from our Tan Sri MB to ask MPAJ to hold a forum with the presence of developers / land owners together with residents of the whole Bukit Antarabangsa to address issues faced by us. (you may refer to the Malay Mail and the Sun dated 11th Feb 2009). Therefore to me, MPAJ was merely carrying out the instruction. Well, here's how I look at it: 1) MB is very concern over our issues here, therefore this forum was called. 2) It could also be an eyewash, like authorities are trying to do their best to be seen working when in actual fact, nothing has been done so far.

Exactly what the motive is, I wouldn't have a clue. What I failed to understand from the State Government's point of view is we have already had a situation here which has to be immediately attended to. We have been kept in the dark for exactly two months ten days so is this forum going to answer our hopes? The committee had wanted to meet the developer, MRCB, since the day it all happened and we just didn't get to do so or rather MRCB had been avoiding us. I remember on 2 occasions we were expecting them and they failed to turn up. In fact, for today's meeting, we were wondering if ever MRCB was going to turn up. Surprise! MRCB turned up but sad to say it is just as good as not to because they sent 2 representatives who hardly know the situations we are in and are not in the least position to answer our requests. So again, where do we go from here? Our insistence of meeting up with MRCB eventually answered. So we now can no longer blame whoever for not letting us meeting up with MRCB. Good, isn't it?

The committee has been following up on all the issues and we know well where we are heading but our authorities administrations are always in our way. Sometimes it is like heading nowhere or just going in circles. I am really surprised by how the residents have lashing it out on MPAJ, developer and authorities this evening. This is really out of my expectation, so in a way, I am glad that many of you out there understand this whole issue of dealing with authorities. Initially, I was very worried that the Tamans' committee will bring up its very own issue, eg. various complaints to be looked into. Having said this, not due to being selfish, I was worried that the slope failure issue would be very much diluted in such a big forum. The concentration would have been directed to other "small" issues.

What we achieved today is very much telling MPAJ how inefficient they have been as an acting body to safeguard our interest. We come back to square one again for they have no answers as to when they / MRCB going to start commencing the remedial work on the failed slope.

This is as much as I would like to say. I have a blog if you do not know about it. It is http://yenhee.blogspot.com/ for you to understand most issues in relations to this tragedy. I started the blog which is a way from the website with the intention of serving as a documentation file for my work. This is because I am one of the evacuees and somehow or rather, my blog has blossomed to some kind of information centre. A lot of work of our initial crisis management has not been posted in. I just couldn't get to do it having to be allocated twice before getting my family a temporary permanent home. Until today, I have not found time to fix a land line therefore my access to the Internet has not been stable for communication purposes.

Thanks for writing in. I will have to say that this is the very first ever longest email I have replied since 6th of December 2008. I don't know you but it has been great corresponding to you as a resident.I would also like to inform you that this correspondence will be posted on my blog for those who could not make it to the forum.

TNB Proposal

Dear residents,

We've received news from TNB that they have come up with a proposal to ease the inconvenience of individual customers in relation to the issue of terminating their electricity supply. This proposal is based on TNB's sincere desire to ensure that residents are not billed for unused electricity (estimated bills) and also to avoid any future confusion.

The Proposal from TNB

Each housing area appoints someone as the Coordinator to handle TNB accounts' termination;
Their identities are announced to the residents in the area - preferably today at the residents briefing at Oakleaf Club;
Residents who wish to have their accounts terminated will have to provide the Coordinators with:
a) copy of the identity card of the registered customer (name on TNB bill) - for safety/ease of mind sake, please cross the edges of the identity cards' copies with the legend "UNTUK KEGUNAAN TNB SAHAJA";

.......b) the account number with TNB; and

.......c) a covering letter to TNB requesting for the termination of the account.

Coordinators will have to announce the deadline for submission to the coordinator, after which the Coordinators will submit the applications for termination to TNB;
After the submission by the Coordinators to TNB, residents who have yet to submit their request for termination of supply could attend personally at the TNB shop in Ampang or in Menara TH Selborn in Jalan Tun Razak (opposite Marinara);
After receiving the submissions, TNB will attend to the disconnection of the meters and the refund of deposits; and
Residents who wish to have their electricity supply reconnected in the future will have to make a fresh application since it was mentioned yesterday that TNB are not allowed to waive or suspend electricity charges.

Assessment / 'cukai pintu' waived for 6 months for all affected residents. Confirmed on Friday 13 Feb by YDP . I will ensure Wangsa 9's periodically.
TNB - billing for Wangsa 9 followed up again on Thursday 12th February 2009 and it has confirmed. Requested on 13 February for MPAJ to write a formal letter to inform TNB & SYABAS which by right they should handle it. Don't worry about future billings, please keep them.
Street lights - to lit up Wangsa 9 proposed on 5th Feb to TNB but MPAJ will attend to it. It has not been done when I was in Wangsa 9 last night. Operation Chief said should be attended to by today.
Police booth - Dato Muneandy met up with OCPD Ampang 16th February 2009 confirmed that booth will be placed at emergency staircase of Wangsa 9 and also Jalan Bukit Mewah 2. Will follow up.
Upkeep on Wangsa 9 - requested again 13th February for Wangsa 9 to be swept periodically
YDP confirmed the request.
Temporary water Wangsa 9 - requested again 13th February for temporary water supply. We may want to wait for JKR REPORT. Did suggest temporary connection for Wangsa 5. Will follow up.

TNB's response : Billings Scare

Credit to our friend Zaman, Cik Yusainiza Mohd Yusof (a member of the customer service and marketing of TNB) has been contacted regarding the electricity billing issues.

The following is the summary of the conversation:

Billings to vacant premises

TNB is willing to assist residents to get accurate readings. If houses are vacant, their meter readers would appreciate it if houseowners could contact them ASAP to arrange for current readings to be taken, so that there will be no estimated bills.

TNB currently cannot under the law waive or suspend their billings - this is pursuant to their license. What has happened is that some houseowners have terminated their TNB accounts. That will prevent future bills from being issued. To terminate the accounts, please go to the nearest TNB office.

Streetlights especially for Wangsa 9

Cik Yusainiza will forward the issue to higher management. It would be better if the residents committee for the affected areas to send consolidated (i.e. non-multiple) e-mails to her to describe the situation so that TNB's management could make a decision.

FORUM TO BE HOLD TOMORROW BY MPAJ TUES 17FEB09

In my capacity, I have tried to make sure that all residents are aware of this meeting. Well, some would have shared the same wondering on what is the agenda for the forum. To me, perhaps Tan Sri MB's instruction to MPAJ to do so within 7 days is with the intention of looking after the public interest BUT don't they now see it that we have already has one in hand yet to be solved and nothing is done about it? So I may interpret the forum to be an eye wash to lead residents / rakyat to think they are listening and doing something for us. We want them TO ATTEND TO OUR PROBLEMS NOT JUST LISTENING. Anyway, it makes no sense when we already have ONE MAJOR ISSUE THAT REQUIRES IMMEDIATE ATTENTION WITH ONE DEVELOPER AND THAT CANNOT BE FIXED AND TOMORROW THE WHOLE BUKIT ANTARABANGSA WILL BE IN A FORUM OF COMMUNICATING WITH 11 OTHER DEVELOPERS. To me, this is just an equation of 'if you have a child who is already sicked and instead of treating your sick child you check with your other children if they are sick'. I am sure other residents in this vincinity have other issues so i did propose to TYDP (meeting Friday 13th Feb) if the forum on the failed slope and directly affected residents be attended separately. We had no reply to the request. I don't know what is the purpose or agenda, we are not interested in them just listening, we should only be interested in WHAT ARE YOU GOING TO DO ABOUT IT, IF NOT YOU THEN WHO AND BY WHEN.

HILLSIDE PROJECTS TO GO ON

With reference to the above, statements made 'total prevention of landslide and freezing construction, both not practical; professional engineers can minimise landslide' - Mohd Zin.

This is just saying landslide cannot be eliminated which is as good as saying instead of risking 10 lives, it can be minimised to 2. As far as the public is concerned, many are against hillside development purely because they are in fear of the consequences of collapse buildings where lives will be sacrificed disregard of other losses.

Mohd Zin also made it clear that hillslope development 'fell under the supervision of local authorities as they are the ones to issue approvals'. I have a simple question to ask, is our local authority or in our case MPAJ fit to uphold such responsibilities? Answer is NO. If they are capable, we as residents wouldn't have to wait more than 2 months and pestering for something to be done. And we are still waiting. In other words, it is just as good as saying we can build and allow it to collapse. It is only a matter of time knowingly our local authorities, MPAJ (in our case) has NO OR POOR

BIGGER BUDGET SET ASIDE by developer SUPERVIEW or may just refused to come up with the money
Geotechnique or hillslope EXPERTS
MAINTAINANCE responsibilities
FOLLOW THROUGH
IMPLEMENTATION and ENFORCEMENT process.

Does MPAJ have all these criteria to act as a body to protect the public interest or act on our behalf to ensure landslide doesn't take place anymore. The answer is NO. Along with these, I would also like to highlight that bribery and corruption go hand in hand for any work need to be carried out and this is also directed to fellow developers who offer. That was as much for MPAJ. So the Work Ministry as an advising agent has not come up with it's JKR report which we requested over and over again for it to be made public. In our Bukit Antarabangsa case, we were all anxiously waiting for the 1st JKR report which was supposed to be announced to us on 18th December 2008 and the said report turned out to be just a KENYATAAN MEDIA 20 December 2008 to inform us who is to be evacuated! So far, the public has not been given access to any of these landslide reports including Highland towers. Our committee most recent meeting with MPAJ , TYDP Dato M. Yaacob also said that they are waiting for the JKR report. We are in the situation or society if we don't hassle the authorities NOTHING IS GOING TO GET DONE! We are dealing with a lot of inefficiencies in our authorities and government departments, we are human beings with feelings so naturally we get furious after too long the wait. I agree and thank our DPM to call on local authorities to BAN hillside development. So we see the conflict in our government administrations now that WORK MINISTRY as on 15th February say they are going ahead. We have a situation where either our DPM does not honour what he said or the ministry goes against what DPM had instructed. It is really unfair to lead to such confusion. Stop fooling us! By the way, if hillslope developments are to go on, I would think that members of our community are on their feet to even buy a property near a slope.

Tuan Syed - Chairman,Wangsa Heights Condo

Residents, Tuan Syed is now in ICU, Ampang Puteri. He had an attack on Thursday afternoon and had 4 by-pass done immediately. I got the news early Friday morning. I went to visit him right after MPAJ meeting. He just regained consciousness then, about 11.30am. Spouse, Aliza said Tuan would receive visitors upon transferring to normal ward probably a couple of days from today. I am sure a lot of you would had received his sms to inform you of the SUN 8th JAN SIGNING PETITION MEETING. Here I would like to share with you that Tuan had to practically sent about 150 sms to you one by one because of his new hdphone. This itself depicts Tuan Syed. For all residents who don't know Tuan, I would like to introduce him as a caring, extreme concern and valuable resident, also a leader to our community who has contributed a lot of his time in taking part to form this present committee and getting everyone as much together to be in our battle for saving Bukit Antarabangsa. Of recent due to his work obligations and travelling, he has not been able to commit as much as he wants to. I saw him on Monday 10th (could not make it on Sun night) to place his signature on the said petition to represent his 208 condo residents. The situation that Tuan is now in clearly tells us he has done his utmost. Let us all pray very hard for such good man to a speedy recovery. I know Tuan Syed and I trust his strong wills.

Desperate Cry for Action MMAIL(thurs 12/2/09)

I was called up by the press on my view yersterday based on SELANGOR GOVERMENT ORDERED MPAJ TO HOLD MEETING WITH RESIDENTS AND LANDOWNERS.....WITHIN A WEEK. I did post the statements made in my blog. Today's article says it all. My only comment is the photo on this article is not justifiable as we described 'torn and tattered' tarps. Tarpaulins seen on this picture are just newly laid after the 5th Feb landslip. (2nd occurence after 6 Dec)

TNB Billings Scare

Some residents and I personally received electricity bills at Wangsa 9 this morning. For your info, this matter had been noted and rectified as on 5th Feb which is also stated in my blog a week ago. I expected this and I had informed fellow residents not to be alarmed. Keep the bills. We sort out at HQ and will inform you accordingly. Again we are dealing with a 'national' tragedy and it takes the residents/committee themselves to inform TNB and SYABAS. Who should have done this?

The FORUM

The forum called by Tan Seri MB to be chaired by MPAJ must serve its purpose that is after the long waited more than 2 months. The forum must have an objective. The OBJECTIVE IS THE SOLUTION to the problem followed by the will to be immediately carried out. We had requested for meetings with the developer together with MPAJ BUT the DEVELOPER FAILED TO TURN UP. MPAJ had close door meetings with the developer which have no solutions. We don't want a forum that is just going to pacify us. We want actions, we have said enough. WHAT NEEDS TO BE SAID HAD BEEN SAID BUT WHAT NEEDS TO BE DONE HAS NOT BEEN DONE. We would have achieved 10 % work to be done by the time the forum is over! TIME IS THE ESSENCE.

I was at YB M.P office to hand over cc of MPAJ petition. I was made to understand that work ministry will present JKR N issue on slope with a substantial rectification work on the overall to cabinet today. I am in no position to commend but if this come through, we would be very thankful. On other matters:

Our effort on public awareness seems to be effective. We have coverage again Malay Mail & Star Metro on 10 Feb. Today 11th Feb SUN page 7.
I am now at MPAJ office to follow up on 3 month subsidies for WARGA TUA for residents whom had appealed.
Working on 'directly' affected house 15,17,19 in their interest to pursue further.
Committee meeting is on tonight. Our concentration & priority is THE SLOPE.

I am aware of other issues like Feb rental subsidy, TNB & Syabas bills and also a better administration of communication. They have been addressed but need to be followed up. In general, I shall try to put all work done in my blog. We are all trying.

Background

In the early hours of 6th December 2008, a landslide occurred on the land located on a man made slope between Jalan Wangsa 9, Taman Wangsa Ukay, Ampang and Jalan Bukit Antarabangsa, Taman Bukit Mewah, Ampang. Both residential areas are located in what is generally referred to as the Bukit Antarabangsa area under your jurisdiction.

A direct consequence of this landslide was that in Taman Bukit Mewah, located on flat land at the bottom of the landslide, 14 bungalows were destroyed with the loss of 5 lives and several injured. A further 20 houses were damaged and these will require from minor to fairly extensive repair works to restore them to a state safe and fit for occupation again.

Jalan Bukit Antarabangsa was cut off together with Jalan Wangsa 9 located at the top of the failed slope resulting in thousands being inconvenienced due to the only vehicular access to their homes being blocked by the landslide. The affected housing schemes included Taman Bukit Mewah, Taman Bukit Jaya and the various condominium schemes like Oakleaf Park, Kyoto Gardens, Impian Selatan etc.

To date, based on an initial report by JKR, 81 houses have been declared unsafe for occupation and the owners/occupiers prevented from occupying their homes. Power and water supply to these homes have also been disconnected. These homes are located in Taman Bukit Mewah (20 homes), one block in Impian Selatan condominium (27 homes), Jalan Wangsa 9 (23 homes), Jalan Wangsa 11 (3 homes) and Jalan Bukit Jaya 6 (8 homes). This evacuation notice was prompted by concerns regarding the stability of the failed slope which will endanger these houses if there was further deterioration.

As early as a week after the incident, it was made known that the JKR Slope Engineering Unit had proposed an immediate remedial plan for stabilizing the failed slope to prevent further deterioration of the slope and surrounding properties. This plan which included measures like soil nailing of the slope below Jalan Wangsa 9, was submitted to MPAJ as the Local Authority for consideration and further action. To date, more than 2 months after the slope failure, other than work to reopen Jalan Bukit Antarabangsa in time for the new academic year, actual remedial works (other than slope investigation and monitoring works) to the slope has not progressed beyond the initial efforts to cover the top of the slope with tarpaulins, repairing drains and sumps (at the request of the residents) in the vicinity of the failed slope and draining of water from a pool that formed at the bottom of the failed slope.

Currently, the tarpaulin cover to the top of the slope on Jalan Wangsa 9 have ripped, further exposing the bare slope through a combination of movement caused by the further collapse of the lip at the top of the slope or general wear and tear. The edge of the collapsed slope which was at the outside edge of Jalan Wangsa 9 on land belonging to Superview Development Sdn Bhd has now eroded to a point less than 10 feet from the boundary/front gates of some houses on Jalan Wangsa 9.

Why immediate action is needed

There is no disagreement from any party to the fact that the failed slope, if left unattended either by way of immediate slope stabilization or a complete rebuilding to restore stability is inherently UNSAFE. The weather had been benign and there was no repeat of the rain spell experienced prior to and in the immediate few days after the occurrence of the slope failure, but this is only a TEMPORARY reprieve. In the last two weeks, the weather has taken a turn for the worse and it has been raining almost daily. Several minor land slips have been reported in the last week, most recently on 31st January 2009 and 5th February 2009. The slope will fail again if left untreated and this will put in jeopardy the remaining houses located on Jalan Bukit Antarabangsa, Impian Selatan, Jalan Wangsa 9, Jalan Wangsa 11 and Jalan Bukit Jaya 6. JKR’s monitoring of the structures after the landslide indicated that these houses although declared unsafe are in fact structurally sound and have remained uncompromised. It is irrefutable that further failure of the slope due to a lack of action NOW to safeguard its stability will cause this situation to change dramatically and probably irreversibly for the worse.

The Facts

Taman Wangsa Ukay was developed by Superview Development Sdn Bhd (SDSB), a subsidiary company of MRCB, a company listed on the Bursa Malaysia, in the eighties and the whole hillside from the Wangsa Heights Condominium on Jalan Wangsa 7 down to the bottom of the hill demarcated by Jalan Bukit Antarabangsa is a man made slope. This slope generally consists of earth berms (using fill material) with bench or berm drains with some crib retaining walls located behind some houses.

Completed houses located on Jalan Wangsa 3, Jalan Wangsa 5, Jalan Wangsa 7 (including the Wangsa Heights Condominium), Jalan Wangsa 9 and Jalan Wangsa 11 were handed over to purchasers from the late eighties to the early nineties. The houses located in Taman Bukit Mewah were completed in the nineties.

Between Jalan Wangsa 9 and Jalan Bukit Antarabangsa, are located several blocks of uncompleted houses which have been left in an abandoned state since the late eighties with no sign of any activity to maintain them or the associated bench drains within the building lots in a serviceable state. The continuation of Jalan Wangsa 11 beyond the last occupied house addressed No 82, was left uncompleted with no evidence of the road works, drainage and street lighting having ever been completed or installed. A kawasan lapang located at the bottom of the slope was never completed with landscaping or play equipment installed for the benefit of residents in the area. A cursory survey of the state of the land and the abandoned buildings will back up any assertion that there has not been any reasonable effort made to maintain the land or buildings, especially with respect to drainage of the slope, in a manner that could be deemed fair and reasonable so as not to cause nuisance to the adjacent landowners.

In the last few years, SDSB had tried to apply for Development Orders to develop their land located where the slope failure occurred, the last was apparently in 2002, to redevelop the abandoned building lots but these applications were unsuccessful. Meanwhile, maintenance activity on the said land was visibly lacking with adjacent owners on Jalan Wangsa 9 and Jalan Bukit Antarabangsa resorting to calling MPAJ to clear fallen trees or listing trees.

The Implications under the Street Drainage & Building Act

It is clear under the Street Drainage and Building Act that property owners and landowners are not to do anything that will result in nuisance or endanger public health or their neighbors or they can be summarily dealt with under Section 86 of the said Act. There are provisions for the Local Authority (in this case MPAJ) to take action to ensure compliance with this as is provided under Part VI Section 91 (Mandatory Order) of the Act, so that ordinary citizens can live in an environment in peace and safety. In the event that there is clear and present evidence that the continuation of an activity or neglect will result in a threat or damage to properties or lives of adjacent neighbors, the Local Authority and the Land Owner whose property or land is the source of the threat MUST take action or be held liable for damages directly or indirectly arising. The Local Authorities can take action to safeguard public health and safety and then recover costs from the offending landowner.

In this instance, the current state of the failed slope which has already claimed lives and property still represents clear and present danger to the remaining houses located on Jalan Wangsa 9, Jalan Wangsa 7, Jalan Wangsa 11, Jalan Bukit Antarabangsa, Jalan Bukit Mewah 1, Jalan Bukit Mewah 2, Impian Selatan and Jalan Bukit Jaya 6.

This potential of further damages is both foreseeable and preventable if action is taken NOW!

It is apparent that while the MPAJ is engaged in a case of trying to establish or deny blame, this fact of continued and imminent danger to the remaining houses has been overlooked with little regard to the potentially catastrophic consequences of this inactivity. We will hold you and the Majlis Perbandaran Ampang Jaya liable for your negligence in spite of warnings that are clear and cannot be ignored.

The Menteri Besar had declared publicly at a press conference on site on 21st December 2008 that the State and the Local Authority have the power and means to go ahead and act to secure the slope and prevent further damages in order to safeguard property and lives and that the present State Government had the resolve to do just that.

The Jabatan Kerja Raya (JKR) through their Slope Engineering Unit under Ir Kamar Kassim had also stated that they will prepare a comprehensive study of the catastrophe and prepare a report that will cover the cause and effect of the landslide and recommend a plan to prevent a recurrence. This report shall be duly presented on 19th January 2009 to the parties having jurisdiction to be acted upon. To date, there has been no word on the actual status of that report.

Today, 2 months have passed since the landslide, there has been neither confirmation nor activity of any sort to make good on promises made, the slope condition is getting critical and we as the rakyat have a right to demand at least a measure of consideration from those in Authority.

An Appeal for ACTION

Dato’ YDP, we appeal to you as the Yang DiPertua Majlis Perbandaran Ampang Jaya and your good office, who are entrusted with the duty and responsibility to look after our interests in this matter, to act NOW to safeguard our interests as outlined above or we may be forced to hold you and the Majlis Perbandaran Ampang Jaya accountable for any damages whether directly or indirectly arising as a result of no action being taken by you and the majlis Perbandaran Ampang Jaya in spite our our appeals to Dato’ YDP and the Majlis Perbandaran Ampang Jaya.

Recurrence of Landslip (2nd time) THURS abt 10.30 pm

Dear residents,

My hunch came through after posting my article '2 Months After the Tragedy'. I am now at site Wangsa 9, wanting to check on the worrisome tarpaulins that was haunting me and only to find that a second slip occurred again between 10 -11 pm after 31st January. This time some uprooted trees fell onto Wangsa 9, causing the increase of caving in almost to the front portion of house no. 15, 19 and 17. (Click for photos) Such impact had jeopardised the surface of the road badly. Some policemen were here and all they can do is to submit report to MPAJ. I shall inform the committee, YB Adun and YB MP.
